Acceptance of Terms of Use. By using the HAWAIIDATING.NET Website, (the “Website”) you agree to be bound by these Terms of Use (this “Agreement”), whether or not you register as a member of HawaiiDating.net (“Member”). By accessing, viewing or using any Services on HawaiiDating.net, you represent and warrant that you are at least 18 years old and the age of majority and legal consent in the jurisdiction in which you live or reside, and you agree to be bound by and subject to these Terms. If you do not agree to these Terms, you should not check or click on, or otherwise agree to, these Terms, and you should immediately leave this page and not access or use the Website or any other Services. Upon our request, you agree to sign a non-electronic version of these Terms.

Use of Services - Assumption of Risk. The Services may not be accessed or used where prohibited by law. Content Posted by You on HawaiiDating.net. You are solely responsible for the Content that you publish or display (hereinafter, “post”) on the Service, or transmit to other Members. You will not post on the Service, or transmit to other Members, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). You will not provide inaccurate, misleading or false information to the Company or to any other Member. If information provided to HawaiiDating.net, or another Member, subsequently becomes inaccurate, misleading or false, you will promptly notify HawaiiDating.net of such change. You understand and agree that HawaiiDating.net may review and delete any content, messages, double-blind emails, photos or profiles (collectively, “Content”), in each case in whole or in part, that in the sole judgment of HawaiiDating.net violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members. By posting Content to any public area of HawaiiDating.net, you automatically grant, and you represent and warrant that you have the right to grant, to HawaiiDating.net, its affiliates, licensees and successors, an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, reproduce, adapt, modify and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing. You further represent and warrant that public posting and use of your content by HawaiiDating.net will not infringe or violate the rights of any third party. Listed below is a partial list of content we prohibit on this website. HawaiiDating.net reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators.
Prohibited Activities.
• Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
• Harassing or advocates harassment of another person;
• Actions involving the transmission of “junk mail”, “chain letters,” or unsolicited mass mailing or “spamming”;
• Actions promoting information that is false, misleading or promoting illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
• Actions promoting an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated images, audio or video, or links to pirated images, audio or video files;
• Providing material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under the age of 18;
• Posting violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive photos or other content;
• Posting or transmitting, through the Site, any defamatory, threatening, obscene, harmful or pornographic material, or material which would violate or infringe in any way the rights of Company or third parties (including, without limitation, intellectual property rights, rights of confidentiality, rights of privacy or rights of publicity) or cause distress, or which does not comply with all applicable laws. You must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive;
• providing instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
• Soliciting passwords or personal identifying information for commercial or unlawful purposes from other users; and
• Engaging in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.
• Including in your Member profile any telephone numbers, street addresses, last names, URLs or email addresses.
• Engaging in advertising to, or solicitation of, other Members. This includes but is not limited to solicitation or advertising to buy or sell any products or services through the Service or to attend parties or other social functions or networking for commercial purposes. You may not transmit any chain letters or junk email to other Members. Although HawaiiDating.net cannot monitor the conduct of its Members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, we reserve the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which we deem appropriate in our sole discretion.
• Impersonating any person or entity.
• Stalking or otherwise harassing any person.
• Expressing or implying that any statements you make are endorsed by HawaiiDating.net without our specific prior written consent.
• Using any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
• Posting, distributing or reproducing in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
• Removing any copyright, trademark or other proprietary rights notices contained in the Service.
• Interfering with or disrupting the Services or the site or the servers or networks connected to the Services or the site.
• Posting, emailing or otherwise transmitting any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• Forging headers or otherwise manipulating identifiers in order to disguise the origin of any information transmitted through the Service.
• 'Framing or “mirroring” any part of the Service or the Website, without HawaiiDating.net's prior written authorization. You also shall not use meta tags or code or other devices containing any reference to HawaiiDating.net or the Service or the site in order to direct any person to any other web site for any purpose.
• Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or the Website or any software used on or for the Service or cause others to do so.
• Putting information on your profile that inaccurate, out of date or incomplete.
• Providing or permitting access or use of the Services, or your Account, by any minors
• Privacy of your mail and instant messages. We consider the content of all of your mail and instant messages to be private. However if it is brought to our attention that your mail and/or instant messages might be in violation of our terms and agreement, we will monitor your mail and/or instant message history to verify that your mail and/or instant messages have been in compliance with our terms and agreement. Should we discover that any mail and/or instant messages sent by you are violation of our terms and agreement, we reserve the right to terminate you membership. I want to stress that we will not intentionally monitor or disclose any of your mail messages and/or instant messages unless we believe in good faith that we are required to do so (i) to enforce these Terms and Conditions, (ii) by law, (iii) to defend us in any action, or (iv) to protect our property. Additionally, you agree to respect the privacy and confidentiality of others. Since privacy is a function of your password, we encourage you to change your password frequently and to not share it with anyone.
Customer Service. HawaiiDating.net provides assistance and guidance through its customer care representatives. When communicating with our customer care representatives, you may not to be abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive, or otherwise behave inappropriately. Telephone calls between you and our customer care representatives may be recorded for quality assurance purposes. If we feel that your behavior towards any of our customer care representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership and you will not be entitled to any refund of unused subscription fees.
Membership billing and other charges. As a member of HawaiiDating.net you can incur two types of charges. The first type of charge is one that you voluntarily make when you opt to use your credit card account to fund a special account on the website that you can use for special purposes (i.e. raise your profile in the search results, etc.). The second type of charge is the membership charge. As a member you can choose to be charged to upgrade your subscription to a paid subscription where you’ll have access to all the site features. For both types of charges, you can use Credit Card or Debit Card. Automatic Subscription Renewal and Subscription Cancelation. Your subscription will continue indefinitely until cancelled by you. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing. You agree that your account will be subject to this automatic renewal feature. If you do not wish your account to renew automatically, or if you want to change or terminate your subscription, please log in and go to the My Account page and unselect the “Auto Renew On” checkbox found in the My Account Status section. If you cancel your subscription, you may use your subscription until the end of your then-current subscription term; your subscription will not be renewed after your then-current term expires. However, you won’t be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period. By subscribing, you authorize HawaiiDating.net to charge your Payment Method now and again at the beginning of any subsequent subscription period. You also authorize HawaiiDating.net to charge you for any sales or similar taxes that may be imposed on your subscription payments. Upon the renewal of your subscription, if HawaiiDating.net does not receive payment from your Payment Method provider, (i) you agree to pay all amounts due on your Billing Account upon demand, and/or (ii) you agree that HawaiiDating.net may either terminate or suspend your subscription and continue to attempt to charge your Payment Method provider until payment is received (upon receipt of payment, your account will be activated and for purposes of automatic renewal, your new subscription commitment period will begin as of the day payment was received).
Reaffirmation of Authorization. Your non-termination or continued use of the Service reaffirms that HawaiiDating.net is authorized to charge your Payment Method. HawaiiDating.net may submit those charges for payment and you will be responsible for such charges. This does not waive HawaiiDating.net's right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially subscribed to the Service.
Free Trials and Other Promotions. Any free trial or other promotion that provides subscriber-level access to the Service must be used within the specified time of the trial. You must cancel your subscription before the end of the trial period in order to avoid being charged a subscription fee.
Our Right to Block or Remove Content. You acknowledge and agree that your communications with other users or members via chats, conferences, bulletin boards, blogs, posts and any other publicly accessible avenues of communication through the Services are public and not private communications. Therefore, we strongly encourage you to use caution before disclosing any personal information about yourself in your public communications. We are not responsible for information that you choose to communicate to other users or members, or for the actions of other users or members, and you agree to indemnify us and hold us harmless from any losses, liabilities, damages or expenses you may incur due to such communications or actions. Except as provided in our Privacy Policy, once you post, send or otherwise make publicly available any Content through the Services ('Personal Content'), you expressly grant us, and hereby represent that you have the right to grant us, a perpetual, irrevocable, world-wide, assignable, sub-licensable, and transferable right and license to quote, re-post, use, copy, reproduce, modify, create derivative works of, incorporate into other works, distribute, transmit, broadcast, communicate, publicly display, publicly perform and otherwise exploit such Content in any form or media, anywhere, and without any notice or compensation to you of any kind. Modifications to Service. HawaiiDating.net reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that HawaiiDating.net shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
IP Address Blocking. In order to protect the integrity of the Service, HawaiiDating.net reserves the right at any time in its sole discretion to block Members from certain IP addresses from accessing the Website.
Proprietary Rights. HawaiiDating.net contains information, data, software, photographs, graphics, videos, text, images, typefaces, sounds, and other material (collectively 'Content') that are protected by copyrights, trademarks, or other proprietary rights, and these rights are valid and protected in all forms, media and technologies existing now or developed in the future. All Content is copyrighted as a collective work under the United States copyright laws, and we own a copyright in the selection, coordination, arrangement, and enhancement of such Content. You may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part. Noncommercial Use.The Services are made available for your personal, noncommercial use. Further, you will not use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user or member without their prior express consent. If you breach the terms of this subsection and/or send or post unsolicited bulk email, 'spam' or other unsolicited communications of any kind through the Services, we reserve all rights, claims and causes of action we may have, statutory or otherwise, including but not limited to, the right to seek statutory penalties for each such unsolicited communication you send through the Services..
